Divorce Law
Alabama permits most forms of no fault divorce as well as traditional fault divorces. No-Fault Grounds:  No-Fault: (1) Irretrievable breakdown of the marriage; (2) complete incompatibility of temperament such that the parties can no longer live together; (3) voluntary separation for over 1 year. [Code of Alabama; Title 30, Chapter 2-1]. It is a separate property state. You must have been a resident of Alabama for six months before you can obtain a divorce.

Under Alabama case law, Alabama is an "equitable distribution" state and the judge has full discretion to divide the any jointly-owned real estate or personal property, but does not have the authority to award the wife's separate property to the husband (regardless of whether the wife's separate property was obtained before or after the marriage).
