Divorce Law
Alabama permits most forms of
no fault divorce as well as traditional fault divorces. No-Fault
Grounds: No-Fault: (1) Irretrievable breakdown of the marriage; (2)
complete incompatibility of temperament such that the parties can no
longer live together; (3) voluntary separation for over 1 year. [Code
of Alabama; Title 30, Chapter 2-1]. It is a separate property state.
You must have been a resident of Alabama for six months before you can
obtain a divorce.

Under Alabama case law, Alabama is
an "equitable distribution" state and the judge has full discretion to
divide the any jointly-owned real estate or personal property, but
does not have the authority to award the wife's separate property to
the husband (regardless of whether the wife's separate property was
