Divorce Law
Florida permits 'irreconcilable differences' type no fault divorces as
well as fault divorces. You must live in Florida for 6 months before
you can obtain a divorce. For an uncontested divorce you need a
marital separation agreement and a short hearing is required. The
process can take as little as 30 days. The dissolution of marriage
action should be filed in either (1) the county where the defendant
resides; or (2) the county where the spouses last lived together prior
to separating.

Property Division
Florida is an "equitable distribution" state. Each spouse can retain
their non-marital property. Non-marital property is all property
acquired prior to the marriage, or acquired by gift or inheritance, or
any property that the spouses agree is non-marital property in a
written agreement.
